Viva AI is your personal AI companion app, developed by Traxrift Pty Ltd. By accessing or using Viva AI, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not use the app.
You must be at least 13 years old to use Viva AI. When you create an account you agree to provide accurate information, keep your login credentials secure, and accept responsibility for all activity that occurs under your account. You may delete your account at any time from within the app or via our website.
Permission is granted to download one copy of Viva AI per device for personal, non-commercial use only. This is the grant of a licence, not a transfer of title, and under this licence you may not:

You agree not to use Viva AI for any unlawful purpose, to attempt to gain unauthorised access to our systems or other users' accounts, to interfere with or disrupt the service, or to attempt to extract, scrape, or reproduce the underlying AI models, prompts, or datasets.
Viva AI offers optional purchases and subscriptions through the Apple App Store and Google Play. Subscriptions renew automatically unless cancelled through your store account settings before the end of the current period. Virtual items and subscription benefits have no monetary value and are not transferable. Except where required by law or by the refund policy of the store you purchased through, purchases are non-refundable. Prices may change at any time.
Viva AI is an AI companion designed for entertainment and companionship. Its responses are generated by artificial intelligence, may be inaccurate, and do not constitute professional, medical, legal, or financial advice. Traxrift Pty Ltd is not responsible for any actions taken based on interactions with the AI.
The materials and services in Viva AI are provided on an 'as is' basis. Traxrift Pty Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Traxrift Pty Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials in the app or on any linked sites.
In no event shall Traxrift Pty Ltd or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation harm to persons or property, loss of data, loss of profit, or disruption of business operations arising out of the use or inability to use Viva AI, even if Traxrift Pty Ltd or an authorised representative has been notified orally or in writing of the possibility of such damage. This includes any advice given by the AI that could lead to harmful, illegal, or life-threatening actions. Users interact with Viva AI at their own risk.
Traxrift Pty Ltd may suspend or terminate your access to Viva AI if you breach these Terms. You may stop using the app and delete your account at any time.
Traxrift Pty Ltd will cooperate with law enforcement authorities by providing required information upon receipt of a valid legal request. These Terms are governed by the laws of Victoria, Australia, and any legal actions or disputes must be resolved within this jurisdiction.
Traxrift Pty Ltd may revise these Terms of Service at any time. Material changes will be published in the app or on our website with an updated version number and effective date. By continuing to use the app you agree to be bound by the then-current version of these Terms of Service.
